I drove past a NO Entry traffic sign. Is it lawful to impose 3 penalty points for this offence.?

The offence took place in a pedestrian area. No element of danger was involved. The sign contravened is set out in legislation. My suspecion is that the offence does NOT demand OBLIGATORY points. Where can I look to find out if this is in fact the case.
